The creative-assembly.com web site and service available at http://www.creative-assembly.com and http://www.creative-assembly.co.uk ("creative-assembly.com") is an online service run and owned by The Creative Assembly Limited ("The Creative Assembly") to provide information and services relating to the Total War series of games namely Shogun: Total War, Medieval: Total War, Shogun: Total War - The Mongol Invasion, Shogun: Total War - The Warlord Edition, Medieval: Total War, Medieval: Total War - Viking Invasion and Rome: Total War (“Total War Games”).
These terms and conditions ("Terms") apply to all and any use of creative-assembly.com and all and any postings, emails and other communications made to or using it or any forum or service run by The Creative Assembly or any other party through creative-assembly.com ("Submissions").
By using creative-assembly.com you agree to be bound by these Terms.
If you do not accept these Terms you should not use creative-assembly.com or make any Submissions.
The Creative Assembly may make alterations to these terms and conditions from time to time and these variations shall become effective immediately upon being accessible from www.creative-assembly.com/terms.html.
creative-assembly.com is principally aimed at the UK and EU markets and no guarantee can be given that the information and services available accord with local laws of any other countries.

Copyright and Trade Marks

All copyright, design rights, database right, patents, and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any applications therefor ("Intellectual Property Rights") in creative-assembly.com belong to and vest in The Creative Assembly, or are licensed to The Creative Assembly, including in the design, layout, look and feel, graphics and images unless otherwise specified. All Intellectual Property Rights in the Medieval: Total War, Medieval: Total War - Viking Invasion, Viking Invasion and Rome: Total War games including without limitation all software, design, look and feel, characters, rules, gameplay, features and characteristics belongs to and vests in The Creative Assembly, licensed for publication throughout the world to SEGA.
Total War, Shogun: Total War, Medieval: Total War, Shogun: Total War - The Mongol Invasion, Shogun: Total War - The Warlord Edition, Medieval: Total War, Medieval: Total War - Viking Invasion, Viking Invasion and Rome: Total War and the Total War logo are trade marks or registered trade marks of The Creative Assembly in the United Kingdom, United States and/or other countries.
DirectX, Direct 3D,DirectSound, DirectDraw, Windows and Microsoft are trade marks or registered trade marks of Microsoft Corporation in the United Kingdom, United States and/or other countries.
QSound and the Q Logo are registered trade marks of QSound Labs, Inc. "Environmental Audio" is a trade mark and the Environmental Audio Logo is a registered trade mark of Creative Technologies Ltd in certain countries.
All other trade marks are the property of their respective owners and The Creative Assembly makes no warranty or representation in respect of any trade mark.

Use of creative-assembly.com and Total War Games

The Creative Assembly hereby grants you a personal, non-exclusive, non-transferable and non-assignable license to use and display, for home, non-commercial and personal use only, one copy of this creative-assembly.com site, including, but not limited to, any files, codes, audio or images incorporated in or generated by it and its software (“Downloaded Content”).
You must include or maintain all copyright and other notices contained or associated with such Downloaded Content.
You may not without the prior written consent of The Creative Assembly and its Licensees:

distribute, modify, transmit, re-use, re-post, or use any or all of creative-assembly.com or the information contained therein for any purpose other than as set out above nor for public or commercial purposes;
provide hypertext links, URL Links, graphic links, hyperlinks or other direct connection for profit or gain to creative-assembly.com;
display, publish, copy, print, post or otherwise use creative-assembly.com and the information contained therein for the benefit of any other website;
process or otherwise use the information contained on or within creative-assembly.com for any illegal or immoral purpose nor use or process the same unfairly;

In the event that any consent is given, you must include all copyright, trade mark and other notices as appropriate.
Consent will not be given in particular in relation to any web site that features unlawful, racist, defamatory, pornographic, inflammatory, or other legally restricted content, including, but not limited to, hacks for any The Creative Assembly games or any other content that The Creative Assembly find objectionable or unlawful. Exceptional use of creative-assembly.com and the Total War Games shall be permitted as follows:

If you are an individual you may use the Total War Games in their entire, unaltered form for your own research and education for non-commercial purposes, provided that such is accompanied by sufficient and appropriate acknowledgement of The Creative Assembly and SEGA as appropriate and for private study.
If you are a state funded or non profit educational establishment you may you may use the Total War Games in their entire, unaltered form for the research and education for non-commercial purposes of your students provided that such is accompanied by sufficient and appropriate acknowledgement of The Creative Assembly and SEGA as appropriate and for private study. This means that the Total War Games may be used by students within the school provided that you have purchased at least one licensed copy of the installed Total War Game for each computer on which it is used and that one copy is not installed on more than one computer. It may however be used by more than one student.
If you wish to review the Total War Games, you may do so and use only such elements and screen shots as is fair and reasonable provided that such is accompanied by sufficient and appropriate acknowledgement of The Creative Assembly and SEGA as appropriate.
If you run a web site or similar service supporting, promoting or acting as a community where fans and player of the Total War Games may interact, you may:

use selected screen shots of a game as is fair and reasonable for review provided that such is accompanied by sufficient and appropriate acknowledgement of The Creative Assembly.
undertake non-commercial mirroring of patches, downloads and demos, so long as you do not alter the patches or demos in any way and all files included with the original patch or demo are present and intact;
provide a reasonable graphical hypertext link to the home page of creative-assembly.com accompanied by sufficient and appropriate acknowledgement of The Creative Assembly.

You may not mirror or translate creative-assembly.com or any Total War Games into another language without written permission from The Creative Assembly and, where appropriate, its licensees.
The Creative Assembly and its Licensees :

reserve the right to refuse permission to host or distribute its patches and demos to anyone, for any reason, at any time;
prohibit the sale or other commercial exploitation of any CD or other media containing maps, add-ons or campaigns found on the Internet or otherwise for any game or product produced by The Creative Assembly without prior written consent;

do not permit, authorise, support or condone the use or distribution of unofficial cheats and/or hacks for use with any The Creative Assembly product;

do not support or condone network/internet play of the Total War Games anywhere but on gamespy.com or through creative-assembly.com unless agreed otherwise or as specifically provided by the particular Total War Game or creative-assembly.com. Specifically, you may not host or provide matchmaking services for any of our games or emulate or redirect the communication protocols used by The Creative Assembly or in the network feature of its games, through protocol emulation, tunnelling, modifying or adding components to the game(s), use of a utility program or any other techniques now known or hereafter developed, for any purpose including, but not limited to network play over the Internet, network play utilising commercial or non-commercial gaming networks or as part of content aggregation networks without the prior written consent of The Creative Assembly;

The Creative Assembly reserve the right to revoke this limited use license at any time, for any reason, and at the sole discretion of The Creative Assembly.

Liability

The Creative Assembly provides and maintains creative-assembly.com for personal entertainment and information about the Total War Games and services free of charge and on an as is basis.
The Creative Assembly shall be liable only to provide creative-assembly.com with reasonable skill and care and gives no other warranty in connection with creative-assembly.com.
The Creative Assembly shall have no liability in respect of any other web site or page on the internet accessible from creative-assembly.com or any other web site. Third party websites with links from creative-assembly.com have not been verified or reviewed by The Creative Assembly and use and access of such is made at your own risk.
Subject as aforesaid, to the maximum extent permitted by law, The Creative Assembly excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect, punitive or consequential loss whether or not such arises out of any problem you notify to The Creative Assembly and The Creative Assembly shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

Your statutory rights as a consumer are available to you and these terms shall not limit any rights you might have as a consumer that may not be excluded under applicable law nor shall it exclude or limit The Creative Assembly's liability for death or personal injury resulting from its negligence nor any fraudulent representation. Chat Rooms and Discussion Forum

The Creative Assembly runs a forum for the exchange of views relating to Total War Games on creative-assembly.com and for fans and players of these games and other products and services to interact. As such it is a mere conduit engaged in the business of providing an entertainment and information service and is engaged in the transmission, storage, retrieval, hosting, formatting or translation of third party communications without selection or alteration of the content of the communication.
You agree and accept that The Creative Assembly has no responsibility to review the content of the Submissions on creative-assembly.com all of which are made available on the basis that The Creative Assembly shall not be required to exercise any control or judgement of the content or the material posted or contained therein.
The views expressed in any Submissions are the views of the individual contributors and not those of The Creative Assembly unless specified otherwise by The Creative Assembly.
In particular but without limitation to the above The Creative Assembly is not responsible for and disclaims all liability in respect of any comments, views or remarks expressed in any Submissions.
The Creative Assembly gives no warranty and makes no representation as to the accuracy, currency or validity of the information and material contained within the Submissions or creative-assembly.com and shall not be responsible for any loss or damage caused as a result of any use of such material.
You agree and undertake that you will not post or transmit to, through or using creative-assembly.com any statement, material or Submission that:

is unlawful or which gives rise to civil or criminal liability;
is technically harmful such as computer viruses, worms, logic bombs or other malicious software or harmful data;
is defamatory, libellous, untrue, discriminatory, obscene, inflammatory abusive or racist in any way whatsoever.

The Creative Assembly has the absolute right to remove any Submissions it deems unacceptable
You agree to indemnify and hold harmless The Creative Assembly against all liability it may have in respect of and arising out of your use of creative-assembly.com and your Submissions.

Termination

The Creative Assembly shall be entitled to terminate this Agreement and immediately remove, cancel or suspend access to and use of creative-assembly.com upon your breach of any part of these Terms whatsoever.
Termination shall be without prejudice to any accrued rights.
The Creative Assembly will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen contingency beyond the reasonable control of such party including without limitation Internet outages, communications outages, fire, flood, war or act of God.

General

Except as provided above there are no other warranties, conditions or other terms, express or implied, statutory or otherwise, and all such terms are hereby excluded to the maximum extent permitted by law (but subject to your statutory and common law consumer rights).

In the event that any part of these terms and conditions is held to be unenforceable, such part will at The Creative Assembly's option be construed as far as possible to reflect the parties' intentions and the remainder of the provisions will remain in full force and effect.
These terms and conditions constitute the entire agreement between you and The Creative Assembly and shall apply to the exclusion of all other terms or conditions of contract which you may purport to propose.
Use of creative-assembly.com and these terms are subject to the laws of England which shall exclusively govern the interpretation, application and effect of these terms and shall be construed in accordance with the laws of England and the parties submit to the exclusive jurisdiction of the English courts.
